  1. Fill out the trademark application form. You can file an application for trademark registration using eTM File on the IPOPHL website.
  2. Provide a clear representation of the trademark. This can be a drawing or a digital image of the trademark.
  3. Specify the goods or services that the trademark will be used for.
  4. Pay the filing fee. The fee varies depending on the number of classes of goods or services that the trademark will be used for.
Step 3: Submit the Trademark Application

After you've prepared the trademark application, you can submit it to the IPOPHL. You can submit the application online through eTM File or in person at the IPOPHL office.

Step 4: Wait for the Trademark Application to be Processed

The IPOPHL will review your trademark application to ensure that it meets all the requirements. Step 5: Receive the Trademark Certificate

If there are no objections to the trademark during the publication period, the IPOPHL will issue a trademark certificate. The certificate will be valid for 10 years from the date of registration and can be renewed for successive periods of 10 years.

International trademark registration is also an option for businesses operating beyond Philippine shores. This can be done through the Madrid Protocol, which simplifies the international trademark registration process.

  3. The DAU must include proof of use of the trademark in the Philippines, such as labels, packaging, brochures, advertising materials, receipts, invoices, or downloaded pages from the website of the applicant or registrant.
  4. Failure to file the DAU within the prescribed period will result in the cancellation of the trademark registration.

Renewing Your Trademark

  1. A trademark registration may be renewed for periods of 10 years after the expiration of the original 10-year term.
  2. The request for renewal may be made at any time within six months before the expiry of the period for which the registration was issued or within six months after such expiry.
  3. The renewal application must be filed with the IPOPHL and must include the following information: the registration number, the name and address of the registrant, the mark, the goods or services covered by the mark, and the date of the registration.
  4. The renewal application must also be accompanied by the payment of the renewal fee.
