If you’ve created a unique design for a product, protecting it is key to maintaining its competitive edge. An industrial design protection safeguards the visual features of a product, such as its shape, pattern, or color. This guide explains what an industrial design is, its benefits, how to register it, and common pitfalls to avoid.

What is an Industrial Design?

An industrial design refers to the ornamental or aesthetic aspect of a product. It can include the shape, configuration, pattern, or color that gives a product a unique appearance. In the Philippines, industrial designs are protected under the Intellectual Property Code of the Philippines (Republic Act No. 8293), granting exclusive rights to the creator to prevent others from making, selling, or importing products with the same design.

Why Register an Industrial Design?

Registering an industrial design offers several advantages:

  • Exclusive Rights: Grants you the exclusive right to use and reproduce the design, preventing unauthorized use.

  • Market Advantage: Protects your design from imitation, giving your product a unique market position.

  • Legal Protection: Enables you to take legal action against infringers who use your design without permission.

  • Increased Value: Adds value to your business as a design asset that can be licensed or sold.

How to Register an Industrial Design in the Philippines

  1. Prepare Your Application: Prepare a detailed description and drawings or photographs of the design, along with the necessary application form.

  2. Submit Your Application: File your application with the Intellectual Property Office of the Philippines (IPOPHL), including all necessary documents and fees.

  3. Formal Examination: IPOPHL will conduct a formal examination to ensure the application meets all requirements.

  4. Publication: Once approved, the industrial design is published in the IPOPHL Gazette to inform the public and allow for any opposition.

  5. Issuance of Certificate: If no opposition is raised, IPOPHL will issue a Certificate of Registration, granting you protection for your design.

Validity and Renewal of Industrial Design Protection

In the Philippines, an industrial design is protected for 5 years from the filing date, and can be renewed for two additional five-year periods, for a total of 15 years of protection.

Common Mistakes to Avoid in Industrial Design Registration

  • Submitting Incomplete Documentation: Ensure all required documents, drawings, or photographs are clear, accurate, and complete.

  • Delaying Registration: Register promptly to secure your rights and avoid the risk of copying or infringement.

  • Neglecting Renewal Deadlines: Keep track of renewal periods to maintain your design's protection.

Legal Framework and References

The primary law governing industrial designs is the Intellectual Property Code of the Philippines (Republic Act No. 8293). This law outlines the requirements, processes, and protections available for different types of intellectual property. The Intellectual Property Office of the Philippines (IPOPHL) is the government agency responsible for handling IP applications and ensuring compliance with the law.
