  4. Publication in the IPOPHL Gazette: If your application passes the examination, it will be published in the IPOPHL Gazette. This allows third parties to oppose the registration if they believe it infringes on their existing rights.

  5. Issuance of the Certificate of Registration: If no opposition is filed, or if any opposition is resolved in your favor, the IPOPHL will issue a Certificate of Registration, granting you exclusive rights to use the trademark in the Philippines.


Validity and Renewal of Trademarks


A registered trademark in the Philippines is initially valid for 10 years from the date of registration. It can be renewed indefinitely for successive 10-year periods, provided that you continue to use the mark and submit the necessary renewal documents and fees.


It is also important to file a Declaration of Actual Use (DAU) within three years from the filing date of the application and every five years thereafter to maintain the registration.
